These Terms of Service ("Terms") govern your access to and use of the website operated by 4 Leaf Herbals ("we", "us", "our") at shop.4leafherbals.com and any related services, including the purchase of products (collectively, the "Services"). By accessing the Services or placing an order, you agree to be bound by these Terms.
1. Eligibility — 21 and Over
The Services are intended exclusively for adults aged 21 or older. By using the Services or placing an order you represent and warrant that you are at least 21 years of age. We reserve the right to require government-issued photo ID at delivery and to cancel any order where age cannot be verified.
2. Nature of Our Products
We sell kratom (Mitragyna speciosa) products including liquid extracts, gummies, and ready-to-drink beverages. Kratom is a botanical product. It is not approved by the United States Food and Drug Administration (FDA) for the diagnosis, treatment, cure, mitigation, or prevention of any disease. Statements made on our website or product packaging have not been evaluated by the FDA.
We are committed to American Kratom Association (AKA) Good Manufacturing Practices standards. Every batch is third-party lab tested for alkaloid content, heavy metals, microbial contamination, and pesticides. Certificates of Analysis are published on our website.
3. Legal Status & Buyer Responsibility
Kratom is federally legal in the United States but is banned, restricted, or controlled in certain US states, counties, and cities, and in certain foreign countries. It is the buyer's responsibility to confirm that kratom is legal at the delivery address. We maintain shipping blocks for jurisdictions where kratom is known to be banned (see our Shipping Policy), but laws change, and the buyer assumes all risk associated with purchases to jurisdictions where local law later restricts kratom.
4. Orders & Payment
All orders are subject to acceptance and product availability. We reserve the right to refuse or cancel any order at our discretion, including (without limitation) orders that appear to be for resale, orders shipping to restricted jurisdictions, orders with payment irregularities, or orders that violate these Terms. If we cancel an order after payment, you will receive a full refund.
5. Pricing & Promotions
Prices are displayed in US Dollars and are subject to change without notice. We are not responsible for typographical errors and reserve the right to correct any pricing error and cancel any order placed at an incorrect price. Promotional codes are subject to their stated terms and may be revoked at any time.

7. Safety Information & Assumption of Risk
Our products are not for use by persons under 21, pregnant or nursing women, individuals taking prescription medications (in particular MAO inhibitors, opioids, benzodiazepines, or other CNS-active drugs), or individuals with liver, kidney, or cardiovascular conditions. Consult your physician before use. Discontinue use and seek medical attention if you experience adverse reactions. You assume all risk associated with use of our products.
8. Intellectual Property
All content on the Services — including text, images, product photography, logos, and the "4 Leaf Herbals" and "Mitra Nade" trademarks — is owned by 4 Leaf Herbals or its licensors and is protected by United States and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
9. Disclaimer of Warranties
The Services and our products are provided "as is" and "as available" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law. We do not warrant that the Services will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, 4 Leaf Herbals will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or our products. Our total aggregate liability for any claim arising from these Terms or the Services will not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless 4 Leaf Herbals, its officers, employees, and agents from any claim, damage, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, or your misuse of our products.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above will reflect the most recent revision. Continued use of the Services after a revision constitutes acceptance of the updated Terms.
